Contract Sections — Please Read & Agree to Each

Section 1 - 48 Hour Guarantee

The Puppy is guaranteed to be in good physical condition at the time of purchase and for 48 hours thereafter. Buyer is responsible for examining Puppy at the time of pick up and agrees that Puppy appears to be healthy and free from injury or defect at that time. Buyer agrees to have Puppy examined by a licensed Veterinarian within 48 hours of pick up. Failure to do so will result in the Puppy Guarantee being void in full. If Puppy is found to have an infectious disease or serious condition at the time of exam Buyer has the option to return Puppy to the Breeder for replacement with another comparable puppy when available. The breeder reserves the right to seek a second opinion from a Licensed Veterinarian at the Breeder's expense. 48 Hour Guarantee does NOT include coverage for easily treatable minor conditions including but not limited to Coccidia, Giardia, Parasites that are acquired after leaving the Breeder's care. 48 Hour Guarantee also does not cover Hypoglycemia - a condition which can be brought on by stress, improper Feeding or care as well as other factors which are out of the Breeder's control once the Puppy is in the Buyer's care.

Section 2 - 1 Year Guarantee

Puppy is guaranteed to be free from Life threatening, congenital or hereditary defects for a period of 1 year after birth. If during this time an inheritable defect is documented by a Veterinarian and presented to the breeder with sufficient supporting evidence and upon the return of the Puppy to the Breeder, the buyer will be entitled to a replacement puppy of the same sex, of comparable or better quality, when available from a same or upcoming litter, after the first puppy is returned to the Breeder. No cash refunds will be permitted. All incurred Veterinary bills are the sole responsibility of the Buyer.

Section 3 - High Risk

Puppies are considered high risk for Coccidia, giardia, other minor parasites, kennel cough and or hypoglycemia. These health issues are easily treatable. They are often brought on by the stress of moving in a vehicle, going to a new home, being introduced to a new food/treats, adjusting to new people, a change of climate or surroundings, contact with other pets or outdoor animals. These conditions rarely arise but if they do, they are rarely serious and are easily treated. Buyer is responsible for all Veterinary bills incurred as a result.

Section 4 - Fitness For Purpose

Buyer understands and agrees that Breeder has no ability to accurately predict or Guarantee the future fitness of any particular Puppy for show or breeding purposes. Buyer understands that Puppy is purchased as being suitable as a companion dog but that no warranty should be considered to have been expressed or implied at any time about the Puppy's future fitness for show or breeding purposes.

Section 5 - Holding Fee

Seller requires a non-refundable $500 Holding Fee to reserve a spot on the waiting list for a Puppy. Fee is due upon request to be added to the waiting list for a current or future Yorkshire Terrier puppy. This fee shall be applied to the total price of the puppy selected or may be transferred to a future litter.

Section 6 - Buyer Agrees To Complete Payments

To complete payments for the puppy by the time the puppy is 10 weeks of age, or on the date of pick up.

Section 7 - Breeder's First Right of Return

In the event that the Buyer can no longer keep the Puppy, Buyer must immediately contact Breeder to arrange for return of the Puppy to the Breeder's possession. Puppy may not be sold, rehomed, gifted or otherwise transferred to another party without direct consent of Breeder.

Section 8 - Return Circumstances

If you return your puppy to us due to an inability to properly take care of it, or for any other reason not covered by our guarantee above, we will accept the return, however, we will not refund your puppy price.

Section 9 - Communication

Contact the breeder if any issues arise, if the buyer has any questions or concerns, if the puppy becomes lost or ill. Remember that the breeder is there for you even after your purchase.

Section 11 - Chosen Puppy

The buyer cannot change their minds about which puppy they want. The buyer agrees that the puppy chosen is the only puppy they will be allowed to take home when the puppy reaches appropriate age. Colors and coat shape can change dramatically in the few short weeks between the time the buyer places the deposit and the time the puppy can go home.

Section 12 - Breeder Agrees To Socialize Puppy

Socialize the puppy daily until the puppy is ready to go home.

Section 13 - Breeder Agrees To Give Updates

Update the buyer regularly on their puppy's progress and health until the puppy goes home.

Section 14 - Breeder Agrees To Proper Care

Have all proper care, first shots, deworming and all necessary care.

Section 15 - Breeder Agrees To Communication

To be there for the buyer to answer any questions or concerns for the entire life of the puppy.

Section 16 - Agreement To Terms

The Buyer Agrees to all the terms in this Contract and understand no other agreements or guarantees are meant or implied. The Buyer has given all information as accurate and true to the best of their knowledge.

Section 17 - Right of Refusal

We reserve the right to refuse a sale at any time for any reason. Thank You.

Section 18 - Not Covered

Not covered - internal or external parasites, hernia, undescended testicles, under or overbite, injury, allergies, heat exhaustion, or hypoglycemia. Not covered is collapsing trachea or luxating patellas (can be caused by injury). Not covered is Leg Calve Perthes. Coccidia, Giardia, hookworm, whipworm, or any type of parasite is NOT COVERED. We do not cover Mites or external parasites.

Section 19 - Diseases/Viruses Not Covered

We do not cover communicable diseases. This includes but is not limited to Parvo Virus, Leptospirosis, kennel cough, Distemper, Adenovirus, and/or any Virus or Bacteria.

Section 20 - Necropsy Is Required

If the puppy passes away in the first year a Necropsy report is required to fulfill the health guarantee. If no Necropsy is performed this contract is considered void. The Necropsy is to confirm the cause of death to be from an inherited Hereditary defect. The Necropsy will be at the Buyers Expense.

Section 21 - Genetic Testing For Breed Purity

Not covered - we do not guarantee any puppy to test as purebred with any of the companies that offer breed type testing. These tests have been found to be extremely inconsistent. The Buyer acknowledges that if they perform any of these tests and the result comes back on the puppy as not 100% breed type, they will not seek any type of refund or benefit.
